POLICE UNDER FIRE OVER INCARCERATION OF A CHILD

THE Zambian Civil Liberties Union (ZCLU) has demanded for the quick conclusion of a thorough investigation into the circumstances surrounding the incarceration of the 8-year-old child at Matero Police post and bring the officers involved to book.

ZCLU Deputy Executive-Director Maurice Makalu told The Scoop that there was need for the police command to ensure accountability and appropriate disciplinary measures were taken against the erring officers.

Mr. Makalu said his organisation strongly condemned the incarceration of the boy, describing it as a disgrace as it was not only a blatant violation of the child’s rights, but that it also showed gross irresponsibility by the police.

He said the incarceration of an 8-year-old child raised an alarming disregard for the child’s fundamental rights and a clear violation of the Penal Code, the Juvenile and Children’s Code Acts, regional and United Nations Convention on the Rights of the Child which provide clear guidelines for the protection of children’s rights, dignity, and well-being.

He said such an act violated the rights of people in society and how they aspired to treat children.

 “In light of this incident, the ZCLU urges the relevant authorities to quickly conclude a thorough investigation into the circumstances surrounding the incarceration of the 8-year-old child at Matero Police Post, ensuring accountability and appropriate disciplinary measures are taken.

“Children, especially those in conflict with the law, require specialized care, protection, and guidance to ensure their rehabilitation and reintegration into society. Subjecting them to incarceration not only compromises their rights but also perpetuates a cycle of harm and can have long-term negative consequences on their development,” Mr. Makalu said.

And Mr. Makalu has condemned Matero Member of Parliament Miles Sampa for circulating a photo of the detained child without adequately covering the face to protect his identity.

He said the act violated the right of a child victim to privacy and confidentiality protected by Section 25(3) of the Children’s Code Act adding that it was imperative that all individuals, particularly public figures, exercised wisdom, caution, and respect when handling sensitive information involving children.

“We shall not hesitate to drag members of the public to court that wantonly violate the rights of children, including the right to privacy,” he said. 

He also said ZCLU was ready to support and collaborate with relevant authorities, civil society organizations, and stakeholders to promote and protect the rights of children in Zambia.

“We firmly believe that every child deserves to grow and develop in an environment that nurtures their well-being and ensures their rights are safeguarded. As the saying goes, ‘It takes a village to raise a child’, he said.
